Agreements between the employer and the foreign worker are required when the National Employment Agency (Agence pour le développement de l’emploi – ADEM) is involved. The contract may include a let-out clause stating that the job relationship won’t begin until the work visa has been approved.
The citizen of a third nation must get an authentic ADEM certificate from the employer and include it with their application for a work visa.
How to Apply
Before beginning employment in Luxembourg, citizens of third countries must submit a formal work permit application to the Immigration Directorate of the Ministry of Foreign and European Affairs.
Applicants must submit their first and last names and addresses in the nation where they currently reside. They must also offer the following in addition to their application:
A copy of their current passport, a visa issued by another EU member state or country that is recognized as one (Iceland, Liechtenstein, Norway, or Switzerland)
A most recent curriculum vitae, diplomas, or credentials; a current certificate of residence or household composition from their nation of residence;
A genuine, most recent certificate from ADEM authorizing the employer to hire the applicant of their choice for the advertised position, along with a Luxembourg-compliant employment contract that has been dated and signed by both the applicant and the employer.
For the spouse, registered partner, or ascendant, a current certificate of affiliation with the Luxembourg Joint Social Security Centre (parent)
Points to note
- Power of attorney: Individuals from other countries may instruct a third party—like their prospective employer—to apply on their behalf.
- The papers must be verified as genuine copies or originals (except for passports and diplomas, for which plain documents will suffice).
- The papers must be accompanied by an official translation done by a sworn translator if they are not written in German, French, or English.
- Only applications that are complete will be handled. Applications that need to be completed will be sent back to the applicant.
- Typically, it takes three months for the Ministry of Foreign and European Affairs to respond.
